The Labor Market Impact Assessment (LMIA) or Letter of Evaluation signifies that, during the recruitment period, no qualified Canadian applicant expressed interest in the position, necessitating the hiring of international staff. It is a crucial document for Canadian employers seeking to hire foreign workers.
Issued by the Employment and Development Agency in Canada, this letter authorizes employers to engage foreign workers. Subsequently, the employer registers the LMIA with the CIC, allowing the foreign worker to initiate a work permit application.
Prerequisites for Obtaining an LMIA.
The Canadian employer has unsuccessfully sought candidates through the Job Bank of Canada.
The type of LMIA required varies based on factors such as the nature of work, wage level, temporary agricultural labor, etc.
Submission of documents validating the company's legitimacy and its capacity to hire new personnel.
Determining the Need for an LMIA.
TFWP Application. An LMIA is mandatory for those applying for the Temporary Foreign Employment Program (TFWP). Upon securing this permit, a confirmation letter copy is furnished to each foreign worker for their work permit application.
International Mobility Program (IMP). An LMIA is not necessary for IMP applications. Additionally, an LMIA is not required for IMP if hiring a French-speaking foreign language worker.
Quebec Specifics. In Quebec, employers applying for the Temporary Foreign Employment Program need a Quebec Work Permit (CAQ) from the Quebec Labor Office (MIFI) instead of an LMIA. However, for IMP applications in Quebec, an LMIA or CAQ is not required.
